BIO MOLENEZ (address at OCEALYS: 60, rue René Descartes CS 93864 PLOUZANE - 29238 BREST Cédex 2, France), offers the sale of products from a catalog accessible on the Internet.


1. Acceptance and application of the conditions

The customer acknowledges having read, at the time of placing the order, the conditions of sale stated here and declares to accept them without reservation. The present general conditions of sale governing the contractual relations between the company Bio Molenez SARL and its customer, the two parties accepting them without reservation. These general conditions of sale will prevail over all the other conditions appearing in any other document, except prior, express and written derogation. The seller is defined below as being the company Bio Molenez SARL, whose registered office is at Océalys  at n°60, rue René Descartes CS 93864 PLOUZANE - 29238 BREST Cédex 2, France.

Buyer acceptance
These general conditions of sale as well as the prices are expressly approved and accepted by the buyer, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, his own general conditions of purchase, the act of purchase entailing acceptance of these general conditions of sale.

Company registered in the Trade and Companies Register of BREST under Siren number 442757571 and the buyer is defined below as being the company or person signing and accepting these conditions of sale. The buyer acknowledges having the capacity to contract under the conditions described below, ie being of legal majority and not being under guardianship or curatorship. The buyer acknowledges having read these T&Cs before placing the order.


2. Price

Bio Molenez SARL reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of order entry (subject to availability). The products remain the property of Bio Molenez SARL until full payment of the price.
The prices of our products are indicated in Euros. The prices indicated on the product sheets are expressed inclusive of all taxes and including VAT for France and the countries of the EEC. When ordering online, the total price indicated in the order confirmation includes the price of the products, as well as the transport costs.

3. Order

The automatic registration systems communicated via the Internet as well as the order forms sent by the customer by post are considered as proof of the nature, content and date of the order. In the event of an order by internet, the company Bio Molenez SARL confirms the acceptance of its order to the customer at the email address that the latter will have communicated. Bio Molenez SARL reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order.
Once the orders have been validated and paid for, no changes can be made.

 

Responsibility
Information and photos present on the site:
The products we offer are described and presented with the greatest possible accuracy. Despite all our precautions, inaccuracies, inaccuracies or omissions may exist. Bio Molenez SARL cannot be held responsible for such inaccuracies, imprecisions or omissions. The photos are presented for information only, they are not contractual.


 

 

4. Availability

In the event of temporary unavailability, Bio Molenez SARL reserves an additional week for processing the order. In the event of the definitive unavailability of a product after placing the order, the buyer will be informed by e-mail or telephone of the items out of order. The buyer will then have one working week (excluding weekends and public holidays) to request the cancellation or exchange of his order by contacting our customer service by e-mail at the following address:atelierdesalgues@gmail.com
After this period, and without return from him, only the available items will be sent and invoiced.

 

5. Delivery

The products will be sent to the delivery address that the buyer indicated during the ordering process. In the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product. Participation in shipping costs is inclusive of VAT. Any delays do not entitle the buyer to claim damages.
The delivery times indicated are not contractual: they are present for information purposes and cannot be guaranteed. No complaint will be accepted in the case of an overrun of the announced deadline.

 

Whatever the delivery method chosen, the customer will receive a shipping number on his e-mail address which will allow him to follow the delivery of his package. It is up to the customer to collect their package within the time allowed.

 

Home delivery by Colissimo:

Delivery times are estimated at 48h – 72h depending on the areas served from the shipment of the package. This is Colissimo delivered without signature. If the recipient is not present at his home when the deliverer comes, the package is delivered to his mailbox, or failing that, to the post office. It is up to the recipient to collect their package within the time limit of 10 working days. A valid identity document will be required to be able to withdraw his package.

 

Delivery by Colissimo relay:

Delivery times are estimated at 48h – 72h depending on the areas served from the shipment of the package. The recipient selects the relay that suits him from the list offered to him. The final delivery is generally made in the chosen relay. However, it happens that a relay is saturated or temporarily unable to receive a parcel, which is more frequent at Christmas time and during the summer holidays. In this case, Colissimo reserves the right to drop off the package at a nearby alternative relay. It is up to the customer to recover his package with a valid identity document in the alternative relay, and this within the time limit (10 working days). Atelier des Algues cannot be held responsible for delivery to a relay other than the one selected, and no compensation can be granted in this case.

 

Delivery by Mondial Relay:

Delivery times are estimated between 2 to 4 days from the dispatch of the package. The recipient selects the relay that suits him from the list offered to him. The final delivery is generally made in the chosen relay. However, it happens that a relay is saturated or temporarily unable to receive a parcel, which is more frequent at Christmas time and during the summer holidays. In this case, Mondial Relay reserves the right to deposit the parcel in an alternative relay nearby. It is up to the customer to collect his package with a valid identity document in the alternative relay, and this within the time limit (3 to 7 calendar days). Bio Molenez cannot be held responsible for delivery to a relay other than the one selected due to a change of operations by Mondial Relay, and no compensation can be granted in this case.

 

Delivery delays: No complaint will be accepted by Bio Molenez after a period of 30 days from the date of shipment of your order.

A delay in delivery cannot give rise to compensation from Bio Molenez.

We decline all responsibility for the extension of delivery times due to the carrier, in particular in the event of loss of products or strikes.



Damaged package
No complaints will be accepted in the event of damage (breakage, leakage, loss, etc.) or theft of packages. In case of visible deterioration, it is imperative to refuse the package without opening it to the carrier, who will then return the package to the sender. As soon as you return to our premises, Bio Molenez will examine your package and contact you to organize a new shipment.

If your package is delivered to you directly in your mailbox and it is unfortunately damaged, you must go to your post office to refuse it (ask them for a damage report) without opening it. If this is not requested on the day of your delivery, the post office will refuse to send it to you and therefore our services will not be able to access any claim for compensation.

 

In the event that the deterioration is not visible on the outside of the package, photos of the package and of the damaged products will be requested from you for support. It is necessary that the number of the package appears on these pictures.

 

Lost package: No complaint concerning the non-receipt of a package will be accepted by our services beyond one month after shipment.

In the event of a visibly lost package, no compensation can be granted before the result of an investigation by the carrier (up to 30 days after the investigation has been opened by our services).

 

6. Returns

The return of packages by carriers is not a priority. A package can take up to 30 days to be returned to Bio Molenez. The management of returns is then fast and generally does not exceed a few days.

 

Returns processing:
Returns under the NPAI reason
These are the packages returned by the service provider responsible for delivery under the mention: Does not live at the Address Indicated.
Processing an NPAI return
After receipt and acceptance of your package by our services, a credit note (total of the order, shipping costs deducted) will be credited to your customer account within 48 hours of receipt of your package by Bio Molenez. You can then place your order again.

Returns under the reason "unclaimed"
These are packages that have not been claimed by customers at the post office within the time allowed. (10 working days for Colissimo, 3 calendar days for Mondial Relay).
Processing a return under the reason "unclaimed"
After receipt and acceptance of your package by our services, a credit note (total order, shipping costs deducted) will be credited to your customer account within 48 hours of receipt of your package. You can then place your order again.


 

7. Payment

The payment of purchases for France is made by credit card (Visa, Mastercard), bank check, Paypal or bank transfer.
Faced with the resurgence of stolen checkbooks or unpaid checks, /// can no longer accept checks for 100 euros or more. they will be systematically returned to the sender.

 

 

8. Secure payment

Our site is subject to one of the most efficient security systems at present, the universal SSL encryption process. The order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement. In case of refusal of the said centers, the order will be automatically canceled and the customer notified by e-mail.

 

9. Satisfied or refunded

  • Any return must be the subject of a return request from the "contact" section of the Bio Molenez site.
    The buyer has a period of 14 days from the delivery of the order (in accordance with the laws resulting from the consumer code (Art L. 221-18 and L. 221-19)
    to return any unsuitable product in its original, unopened packaging (excluding products received as gifts).
    - The Products must be returned within fourteen (14) days following notification to Bio Molenez of the Customer's decision to withdraw.
    This period begins to run at the beginning of the first hour of the first day and ends on the expiry of the last hour of the last day of the period.
    If this period expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day.

It is advisable to return the parcel by tracked mail, in the event that it is lost during the postal dispatch,
the responsibility of Bio Molenez SARL cannot be engaged in this respect.

- Bio Molenez will then reimburse in the form of having the product returned or by direct reimbursement depending on the method of payment used by the Customer when ordering.
Return shipping costs are the responsibility of the customer.

In the event of an exchange, if the customer wishes to place a new order, the shipping costs will be at his expense.

On the other hand, we will not be able to resume:
- items returned incomplete, damaged, damaged, opened or soiled by the customer
- items not delivered intact with their labels in their original packaging (if present)
- the reasons for allergy or dissatisfaction with the smell of the product will not be valid for return, exchange and or refund of product
- parcels for which no attached element makes it possible to identify the sender (neither order, surname, first name, address, nor telephone),
elements which will be to be written on plain paper in accompaniment of the returned product(s)...
Return costs will be borne by the sender. The return of the products will give rise to a credit note, equal to the purchase price of the product(s) purchased.
The credit therefore does not include any delivery and/or gift package costs.

As soon as your return has been processed, we will send you an e-mail or telephone you informing you of the amount of your credit note or refund.

After a period of 30 days from the date of shipment of your order, no claim will be accepted.

Refund conditions:

In the event of non-receipt of the order within the aforementioned delivery times, for any reason other than force majeure or the act of the Customer,
the sale may be canceled at the Customer's written request, under the conditions provided for in articles L. 216-2 of the Consumer Code.
The sums paid by the Customer will then be returned to him no later than fourteen (14) days following the date of termination of the contract by the Customer,
excluding any compensation or deduction.

In the event of unavailability of the Product ordered, the Customer who has opted for reimbursement will be reimbursed for the sums paid no later than thirty (30) days from their payment.

In the event of exercise of the right of withdrawal within the period referred to in Article 8, only the price of the Product(s) purchased and the delivery costs are reimbursed,
the return costs remain the responsibility of the Customer. The Customer will be reimbursed within fourteen (14) days of receipt of the Products by Bio Molenez SARL.
The refund will be made according to the method of payment used by the Customer when ordering.

Bio Molenez SARL reserves the right to cancel and refund all orders made by a professional.

 

10. Applicable law of disputes

>Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact the company to obtain an amicable solution. This contract is subject to French law. The language of this contract is French. In the event of a dispute, the Court of Tours has sole jurisdiction. Bio Molenez SARL cannot be held liable for damages of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the products marketed. The liability of the company Bio Molenez SARL will, in any event, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have persisted despite all the precautions taken in the presentation of the products. In all cases, the company Bio Molenez SARL cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt, its liability is systematically limited to the value of the product in question, value on its date of sale and this without the possibility of recourse to the brand or the company producing the product.

 

11. Personal information

Bio Molenez SARL undertakes not to disclose to third parties the information provided by buyers and visitors to the site. These are confidential. They will only be used by its internal services for order processing and only to reinforce and personalize communication, in particular through information letters / e-mails as well as in the context of the personalization of the site according to the preferences observed by the users.
This article cannot prevent the assignment or transfer of activities to a third party. In accordance with the Data Protection Act of January 6, 1978, the buyer has a right of access, rectification, and opposition to personal data concerning him. To do this, simply make the request by e-mail or by post, indicating the e-mail address, surname, first name and address.

12. Protection of personal data

Bio Molenez SARL strictly applies the law 78-17 of January 6, 1978 relating to "data processing, files and freedoms" as well as the ethical principles which result therefrom with regard to the personal information that you may be required to communicate to us within the framework of an order placed on our website.

Transmission of personal data to third parties
The Personal Data collected when you register for the online store is used to enable Bio Molenez SARL to identify the authors. Unless expressly authorized by you collected on the Site, your Personal Data is not transmitted to third parties by Bio Molenez SARL.


Right of access and rectification of transmitted data
As provided for by article 34 of the law "Informatique et Libertés" of January 6, 1978, you have the right to access, modify, rectify and delete data concerning you.
